This literature commends attention to sin-talk because it helps religious ethicists to render more adequately the dynamics of human agency, sociality, and culture and because it raises questions about the nature and task of (...) theology, faith, and morality. The mere contact with other people and their various religions, for example, through commerce, still does not indicate religious pluralism. In this case, each (...) group of people has its religion and its gods, and recognizes that other groups of people exist with other religions and other gods. Religious pluralism occurs when, because of immigration or the conquest of one people over another, groups of people with different religions live together in the same social space.Whether by immigration or by conquest, the resulting religious pluralism does not occur in an egalitarian or harmonious manner. Immigrants are forced to live out their religion within their group as a marginal religion in society, or even in hiding when it is not accepted in the society where they went to seek a livelihood. In the case of conquest or expansion of empires, the conquering power imposes its cultural values and religion on the conquered peoples. The empire can try to extinguish the religions of conquered peoples and impose their own as if it is the only one acceptable, or tolerate them as long as these religions do not question the imperial order. That’s because the “encounter” between religions takes place in a situation of colonial conquest and domination. Expecting that there could be a relationship of respect and dialogue among equals would ignore the role of religion in premodern societies, especially in the processes of domination.In these societies, religion has the function of being the foundation of the world-view that legitimized the existing social order, as well as the process of external conquest. Religion fulfills the function of legitimizing and justifying the conquest and consequent exploitation and oppression of the conquered people. Most people have the intuition that, when we can save the lives of either a few people in one group or many people in another group, and all other things are equal, we ought to save the group with the most people. However, several philosophers have argued against this intuition, most famously John Taurek, in his article ‘Should the Numbers Count?’ They argue that there is no moral obligation to save the greater number, and that we are permitted to save (...) either the many or the few. I argue in this article that, even if we are almost completely persuaded by these ‘numbers sceptics’, we ought not to just save the few. The present study aims to deconstruct the myth of origin, a quest after essential identity, in the context of Japan's colonization of Korea (1910-1945). First, I will contextualize the myth of origin as a particular historical construction of Japanese colonization, which stems from Romantic nationalism in the second half of the 19 th century. Then, I will critique the structuralism, monologism, and colonialism standing behind the myth of origin through the lens of deconstruction, dialogism, and hybridity: (1) Jacques Derrida's deconstruction (...) and différance will show the self-implosion of the totalizing, centering vision of structuralism; (2) Mikhail Bakhtin's dialogism will analyze colonial discourse as a double-voiced discourse constituting both dominant discourse and counter-dominant discourse; (3) Homi Bhabha will demonstrate that colonial identity is ambivalent and hybrid through partial mimicry. This article focuses on a psychological phenomenon discussed by the early Confucian: yuan 怨, which is often translated as “resentment”, “grievance”, “lament”, or “complaint”. I attempt to use the early Confucian discussions of yuan to shed light on an aspect of human psychology, namely, when one laments about certain conditions that obtain in such a way that she sees as beyond her control and negatively affects her. This is an unusual reactive attitude because one who has yuan takes the “passive (...) stance.” This paper has four main sections: the first section makes textual observations of “yuan” in the early Confucian texts; the second section proposes a Confucian-inspired account of yuan and highlights the psychological state in which one who has yuan sees oneself as object; the third section discusses the problematic dimensions of yuan; the final section discusses the negative implications of the passive stance with respect to contemporary concerns: vulnerability, moral repair, and self-respect. This essay analyses the Confucian conception of xin, an attribute that broadly resembles what we would ordinarily call trustworthiness. More specifically, it provides an analysis of the psychology of someone who is xin and highlights a feature of the Confucian conception of trustworthiness: the trustworthy person has to ensure that there is a match between her self-presentation and the way she is. My goal is not to argue against any of the existing accounts of trustworthiness but to draw on Confucian (...) insights so as to shed light on features of trustworthiness that are overlooked in current discussions. I hope to show that the Confucian conception of trustworthiness puts more emphasis on the way a trustworthy person actively tries to make sure another’s dependency on her is not unwarranted than on how the trustworthy person responds to the one who gives trust. Conventionalists hold that the sorts of events that one survives—such as teletransportation, or a brain transplant—is at least partly determined by our attitudes. But if Conventionalism is true, whose attitudes directly determine whether one survives? Do the individual's attitudes do all the work as Private Conventionalists hold, or do the community's attitudes also factor in as Public Conventionalists hold? There has recently been a greater push towards Private Conventionalism, while explicit arguments for Public Conventionalism are difficult to come by. This paper argues that yu 欲 (desire), in Xunzi’s view, cannot by itself motivate action. Such a clarification will also bear on our understanding of the relation between xin 心 (the heart/mind) and yu in the Xunzi. This paper is divided into three main sections. The first section seeks to explicate the common assumption that yu can be an independent source of motivation. In the second section, I will conduct textual analysis that challenges such an assumption and argues that only (...) xin can by itself motivate action. In the third section, I explain that the issue of whether yu can conflict with xin is not applicable in Xunzi’s thought and extrapolate the implications that xin is always activated and that xin has natural inclination to pursue the objects of yu. For these reasons, the source of moral failure lies in xin being active in certain problematic ways. (shrink)

ABSTRACT I motivate ‘Origin Conventionalism’—the view that which facts about one’s origins are essential to one’s existence depends partly on our person-directed attitudes. One important upshot is that the view offers a novel and attractive solution to the Nonidentity Problem. That problem typically assumes that the sperm-egg pair from which a person originates is essential to that person’s existence; in which case, for many future persons that come into existence under adverse conditions, had those conditions not been realized, the individuals (...) wouldn’t have existed. This is problematic because it delivers the counter-intuitive conclusion that it’s not wrong to bring about such adverse conditions since they don’t harm anyone. Origin Conventionalism, in contrast, holds that whether a person’s sperm-egg origin is essential to their existence depends on their person-directed attitudes. I argue that this provides a unique and attractive way of preserving the intuition that the actions in the ‘nonidentity cases’ are morally wrong because of the potential harm done to the individuals in question. This paper aims at foregrounding race and ethnicity discourse in Biblical Studies and beyond in order to undermine transhistorical and transcultural racism and ethnocentrism in religious discourse. It is my argument that matters of race and ethnicity should be approached as analytical categories in an interdisciplinary manner, albeit in a specific context, Hellenistic, Roman, Jewish, or Christian. In doing so, I first examine the works of Steve Fenton as well as Robert Miles and Malcolm Brown in order to look closely (...) at race and ethnicity discourse in the ancient Mediterranean world, especially from a sociological perspective. Then, I indicate how Jonathan Hall and Shaye Cohen examine Hellenic and Jewish identity, respectively, with a focus on ethnic identity in the Greco-Roman world. Finally, I consider how Judith Lieu and Denise Buell analyze early Christian identity as a racial or ethnic discourse in the Jewish, Hellenistic, and Roman matrix. Hence, I contend that identity in general and racial-ethnic identity in particular are by no means stable and static in essentialist terms, but rather they are fluid along the ostensible axis of fixed identity. The Growing Block Theory of time says that the metaphysical openness of the future should be understood in terms of there not being any future objects or events. But in a series of works, Ross Cameron, Elizabeth Barnes, and Robbie Williams have developed a competing view that understands metaphysical openness in terms of it being indeterminate whether there exist future objects or events. I argue that the three reasons they give for preferring their account are not compelling. And since the (...) notion of “indeterminate existence” suffers conceptual problems, the Growing Block is the preferable view. (shrink)

This article seeks to advance discussion of Xunzi’s view of ritual by examining the problem ritual treats and the way in which it targets the problem. I argue that the root of the problem is the natural inclination of the heart/mind to be concerned only with self-interest. The reason ritual works is that, on the one hand, it requires one to disregard concern for self-interest and observe ethical standards and, on the other, it allows one to express feelings in an (...) ethically appropriate way. The ideal character shaped by ritual is one of respect in dealing with affairs and people; the ideal effect of ritual on the person is a sense of ease and security. Based on these conclusions, I will flesh out an implicit assumption Xunzi might have adopted about a pattern in human psychological constitution so as to further our understanding of Xunzi’s moral psychology. All individual terms listed as jāti-s (sophisticated ripostes) in Nyāyasūtra V a 1 have the peculiar uniform ending -sama. The interpretation of this ending here reveals a greater nuance of meaning than the hitherto customary understanding of it. It will be demonstrated that the observable semantic difference is due to a historical shift of signification as a result of an enlarging and systematizing of the thematic group of jāti-s. In this paper, I examine relevant text material, including two very important (...) manuscripts of the Nyāyabhṣya to show this semantic difference. The understanding gained by this analysis will help to trace the historical development of the complex of jāti-s within the larger context of the ancient Indian tradition of debate. (shrink)

There has been a growing charge that perdurantism—with its bloated ontology of very person-like objects that coincide persons—implies the repugnant conclusion that we are morally obliged to be feckless. I argue that this charge critically overlooks the epistemic situation—what I call the ‘veil of ignorance’—that perdurantists find themselves in. Though the veil of ignorance still requires an alteration of our commonsense understanding of the demands on action, I argue for two conclusions. The first is that the alteration that is required (...) isn’t a moral one, but rather an alteration of prudential reasoning. Second, and more importantly, this alteration isn’t necessarily a repugnant one. In fact, given that it prudentially pushes one towards greater impartiality, it may be seen as a point in favor of perdurantism. (shrink)

This article seeks to interpret Mencius’ criticism of the village worthies and shed light on the distinctive psychological phenomenon that Mencius has captured but not quite articulated. An attempt at filling out the Mencian view of the village worthies will help us better understand the content of the moral charges made against them and also deepen our analysis of the kind of psychology that early Confucians regard as crucial to moral agency. Following an introduction that overviews Mencius’ criticisms of the (...) village worthies, the main discussion of this article is divided into three sections. Section 2 offers an interpretation of the psychology of the village worthy and articulates the way in which the village worthy can be regarded as a special kind of hypocrite, which I label as “appearance-only” hypocrite. Section 3 draws on the proposed interpretation to make sense of Mencius’ criticisms of the village worthy. I argue that while the village worthy can elude some common charges against hypocrisy, it is still problematic in the sense that it weakens an unstable system of morality from the inside and inflicts harm on the genuinely virtuous person. Section 4 delves deeper into analyzing the ethical implications for the self and for others. (shrink)

This paper is a section that is included in a philosophy of education doctoral thesis on John Locke’s educational epistemology. In this part, I argue that Locke’s conception of liberty as limited based on the natural law and later the civil laws can shed a light on our understanding of freedom in our educational practice. Lockean call for the balance between limited freedom of individual and limited governance of political authority is theoretically translated at the end of this paper into (...) the call for the practical balance between limited freedom of students and limited governance of teachers. Then this paper will offer logical ground for Locke’s understanding of freedom and its limitation, and suggest a theoretical connection to an argument on epistemic liberty in education. (shrink)

In this paper, I analyse the nature of a particular form of theoretical reasoning—ratiocination. Ratiocination is purposeful, self-conscious, deliberatively controlled reasoning. I will argue that ratiocination concludes when the ratiocinator believes that she ought to believe p. In Section 1, I suggest that the way a reasoner’s mind moves in ratiocination is different from the way her mind moves in non-ratiocinative reasoning. Such a difference should motivate an analysis that focuses just on ratiocination. In Section 2, I provide a general (...) characterisation of ratiocination and distinguish it from non-ratiocinative reasoning. I draw a distinction between non-deliberative rational control and deliberative rational control. I then argue that the ratiocinator always exercises the latter. Since theoretical reasoning is a norm-governed activity and since ratiocination involves deliberatively controlled reasoning, the ratiocinator necessarily tries to control her mental movements in a way that is in line with the normative requirements of this activity. In Section 3, I argue that ratiocination ends when the ratiocinator believes that she ought to believe p. I further explain the nature of the ‘ought’ in the ratiocinator’s belief that she ought to believe p. In Section 4, I address possible objections to the account on offer and explain why my account does not undermine our general understanding of the nature of theoretical reasoning. I explain that my claim is compatible with the claim that reasons to be rational are transparent to reasons to believe p. I also discuss why the ratiocinator’s belief that she ought to believe p is not an intermediate stage in ratiocination. Finally, I argue that ratiocination, as described, is compatible with the claim that belief is truth-governed. (shrink)

There has been a growing worry that perdurantism—and similarly ontologically abundant views—is morally untenable. For perdurantism posits that, coinciding with persons, are person-like objects, and giving them their moral due seems to require giving up prudentially driven self-sacrifice. One way to avoid this charge is to adopt consequentialism. But Mark Johnston has argued that the marriage of consequentialism and perdurantism is in moral trouble. For, depending on the nature of time, consequentialist perdurantists either are unable to do more than one (...) good act or they are morally obliged to adopt a repugnant form of ageism. I argue both that perdurantist consequentialism doesn’t have the latter implication, and that there’s at least one plausible form of consequentialism that perdurantists can adopt to avoid the former implication. This paper analyzes the ‘Theory of Inverse Numbers’ that appears in Chapter 3 of the “Shuogua zhuan” 說卦傳 in the I Ching and seeks to apply the findings to the Yi studies of Cheng Yi. The Yi studies of Shao Yong, Zhu Xi, and Cheng Yi are generally explained in the categories of Xiangshu(Image-Number) Yi studies and Yili(Meaning-Principle) Yi studies. However, upon analyzing the ‘Theory of Inverse Numbers’ as a theory representing numbers of principles, it is evident that the framework (...) of this theory is also reflected in Cheng Yi’s Yi studies. The analysis of the ‘Theory of Inverse Numbers’ was conducted through the interpretations of Shao Yong and Zhu Xi, proposing the concept of the ‘Theory of Inverse Numbers’ as a Yi interpretation framework that accounts for what has already occurred [yisheng 已生] and what has not yet occurred [weisheng 未生]. By applying the Yi interpretation framework of what has arisen and what has not, which was developed through the explanations of Shao Yong and Zhu Xi, to Cheng Yi’s Yi studies, it is revealed that even though Cheng Yi does not directly mention Chapter 3 of the “Shuogua zhuan,” the narrative framework of Yichuan Yizhuan 伊川易傳 can be well elucidated by the ‘Theory of Inverse Numbers.’ Accordingly, it suggests that viewing Cheng Yi’s Yi studies merely as a dichotomy of meaning-principle and image-number is limited, and that the concept of Xiangshu Yi is inherent in Cheng Yi’s Yi studies. In other words, the ‘Theory of Inverse Numbers’ as a theory of principle-representing numbers originating from Shao Yong is inherent throughout Cheng Yi’s interpretation of the I Ching as a framework of Yi interpretation for what has arisen and what has not, and this was systematized as the ‘Theory of Inverse Numbers’ by Zhu Xi. This paper explores Ham's role as a maverick thinker, a pacifist and an innovator of religious pluralism in twentieth century Korea. Ham saw an individual's spiritual quest and the struggle for social justice as interrelated. As an idealist, Ham viewed human beings basically as moral beings, and perceived the Supreme Being or God not only as a transcendental being, but also as an imminent being both in the sense of existing everywhere and also in the sense of existing as `inner (...) voice'. On this basis, my paper examines Ham as an intermediary between East Asia and the West and between `losers' and `winners' in history, and assesses how he was shaped by, and responded to, the challenges of his time. Firstly, I will look at Ham's search for Korea's national identity under Japaneseimperialism and his determination to write an account of Korean history from the standpoint of the oppressed, in order to inspire his downhearted countrymen. I will also examine how, using his own Biblical interpretation of Korean history, Ham provided a mission and vision not only for oppressed Koreans under Japanese colonialism, but also for 'losers' and ordinary people everywhere. In the second section, I will further explore Ham's sense of pacifism by examining how Ham's ideas were open-ended not only towards the Asian classical philosophies of Taoism, Confucianism, Buddhism and Hinduism, but also towards traditional Christianity, the non-church movement, Quakerism, Western sciences and rationalism. I will also consider why he had to respond as an individual to the challenges both of society and of the historical era. In the third section, I will concentrate on how Ham's Christo-centric views had fundamentally altered to a more universal perspective and also how he asserted the necessity for the restoration of Christianity from the ceremonial and `weird' to the ethical and socially just. Lastly, I will look at Ham's definition of Jesus and why he used the new terminology the 'Ssial' instead of the archaic expressions 'people' or 'national.' By doing so, I will examine how Ham achieved what is one of the most difficult things in this world, to be a genuinely conscientious leader despite corrupt surroundings. (shrink)

Existentialism claims that propositions that directly refer to individuals depend on those individuals for their existence. I argue for two points regarding Existentialism. First, I argue that recent accounts of Existentialism run into difficulties accommodating the possibility of there being a lonely alien electron. This problem is distinct from one of the better-known alien problems—concerning iterated modal properties of aliens—and can’t be solved using a standard response to the iterated case. Second, though the lonely alien electron problem might seem to (...) be reason to reject the sort of Existentialist view at hand, there’s a plausible way to preserve the view: accept the existence of possible worlds that directly refer to individuals that don’t exist in those worlds. Such a solution might seem incompatible with Existentialism, but I show that Existentialists can avoid the incompatibility and should find the resulting view plausible. (shrink)

This paper analyses the connection between knowing Dao and ethical transformation in Xunzi’s thought. While there have been many discussions concerning what Dao is and how one may come to Dao, there has not been sufficient attention on how knowing Dao leads to ethical transformation. In Section 2, I explicate Xunzi’s concept of bi 蔽 and suggests that one’s not knowing Dao has to do with a certain problematic state of the heart/mind. In Section 3, I analyse xu虛, yi 一, (...) and jing 靜, which are remedial practices for knowing Dao, and bring out the importance of discerning li 理 for Xunzi. In Sections 4 and 5, I propose an interpretation of the relation between li 理 and qing 情 in the process of ethical transformation. In Section 6, I highlight some remaining ambiguities that can be further investigated to deepen our understanding of Xunzi’s thought. (shrink)

Presentism says that only present objects exist. But the view has trouble grounding past-tensed truths like “dinosaurs existed”. Standard Eternalism grounds those truths by positing the existence of past objects—like dinosaurs. But Standard Eternalism conflicts with the intuition that there is genuine change—the intuition that there once were dinosaurs and no longer are any. I offer a novel theory of time—‘The Imprint’—that does a better job preserving both the grounding and genuine change intuitions. The Imprint says that the past and (...) present exist, but where the present exhibits mass-energy, the past only consists of curved empty regions of spacetime. We therefore avoid saying that there are dinosaurs, since there is no mass-energy in the past; but the curvature of the past gives us a way to ground the truth that “dinosaurs existed”. (shrink)

The Zhuangzi 莊子 depicts persons as surviving their deaths through the natural transformations of the world into very different forms—such as roosters, cart-wheels, rat livers, and so on. It is common to interpret these passages metaphorically. In this essay, however, I suggest employing a “Conventionalist” view of persons that says whether a person survives some event is not merely determined by the world, but is partly determined by our own attitudes. On this reading, Zhuangzi’s many teachings urging us to embrace (...) transformation are not merely a psychological aid for dealing with death, but also serve as a tool for literally surviving it. Dualism about possible worlds says that merely possible worlds aren’t concrete objects, but the actual world is concrete. This view seems to be the natural one for ersatzers about merely possible worlds to take; yet one is hard-pressed to find any defenders of it in contemporary modal metaphysics. The main reason is that Dualism struggles with the issue of how merely possible worlds could have been actual. I explain that there are two different Dualist strategies that can be taken to (...) address the problem. Furthermore, one or other of these strategies should be plausible to anyone who accepts both Existentialism—which tells us that the existence of singular propositions depends on what they directly refer to—and Serious Actualism—which tells us that things must exist in order to instantiate properties. The idea that God creates out of Himself seems quite attractive. Many find great appeal in holding that a temporally finite universe must have a cause, but I think there’s also great appeal in holding that there’s pre-existent stuff out of which that universe is created—and what could that stuff be but part of God? Though attractive, the idea of creation ex deo hasn’t been taken seriously by theistic philosophers. Perhaps this is because it seems too vague—‘could anything enlightening be (...) said about what those parts are?’—or objectionable—‘wouldn’t creating out of those parts lessen or destroy God?’ Drawing from Stephen Kosslyn and Michael Tye’s work on the ontology of mental images, I respond to the above questions by developing a theory on which God creates the universe out of His mental imagery. A special supplement [of Kuang-ming Daily] published an article by Comrade Chu-ko Yin-t'ung entitled "Can the Law of Contradiction Be Contravened?"; in it he maintains that the law of contradiction, as well as the other laws of formal logic, must be observed in every situation. "When thinking dialectically, the laws of formal logic must always be observed." His chief argument is that "we have still not found an example in which the law of contradiction has been contravened." In addition to (...) explaining the three generally accepted judgments resulting from dialectical thinking on the definitions, etc., of mechanical motion, he asserts that they actually contain no "logical contradictions." There are, however, other arguments; and since, after the article was published, there were some who opposed it and some who agreed with it, I thought I would contribute to the discussion. (shrink)

I present a new theory of the composition of material objects. An important component of it is the claim that objects have non-concrete objects as parts. A non-concrete object is an object that lacks many of the features that concrete objects typically have—size, shape, mass, location, causal abilities, etc.—but yet is unlike typical abstract objects since a non-concrete object could have those features. This is an ontology defended by Timothy Williamson, but I employ it in a new manner to solve (...) problems in the metaphysics of material objects. Specifically, I think it allows us to improve upon the Worm Theory, which claims that objects persist through time by having temporal parts. One main argument for Worm Theory is that it can preserve the principle that no two objects can share all the same proper parts. This is a principle that I think is intuitively gripping, but that I also argue for. Worm Theory therefore is to be preferred to the more ‘commonsensical’ Endurantist view on which objects are ‘wholly present’ at each moment at which they exist; the reason being that Endurantism gives the result that objects—like a statue and the clay it’s made out of—share all the same proper parts. By instead claiming that such objects also have temporal parts, Worm Theory manages to avoid this bad result for particular cases. The problem, however, is that it can’t avoid that result for all cases. We can easily imagine cases in which a statue and the clay from which it is made come into and out of existence at the exact same times. Thus the objects would not differ even with respect to their temporal parts. The view that I advance instead claims that objects must have something like modal parts. Thus we could say that since there is a possible world in which the clay exists without the statue, they do not completely overlap with respect to their modal parts. And so we avoid the bad result for all cases. The problem, however, is that there are no such things as objects that don’t actually exist. Hence, there couldn’t be such modal parts. Nonetheless, we can get something like modal parts by holding that such things actually exist, but are simply not actually concrete. Thus, the ‘pieces of clay in other worlds’ do actually exist, but they are not actually pieces of clay. They are non-concrete objects that could be pieces of clay. So even in a case where the clay and statue are created and destroyed at the same times, they differ with respect to their non-concrete parts. I call this the LED Theory because objects resemble LED display boards: just as the board is composed of numerous lights, each of which can be on or off, so objects are composed of numerous parts, each of which can be concrete or non-concrete. Legal scholars have been inspired by the dialogic approach and rallied around it as the solution to constitutional conflict in domestic constitutional orders and the transnational legal landscape. This paper aims to show that the gravitation towards judicial dialogue in contemporary constitutional theory misses the point, given the ambiguities surrounding it. My investigation reveals that the dialogic approach does not succeed in guiding the inter-departmental or inter-regime interactions in a way that no single power would exert unilateral domination. The emergence (...) of judicial supremacy in both national and transnational constitutional orders further suggests that underlying those ostensible examples of judicial dialogue is a transfigured conception of sovereignty. As it is the rise of judicial sovereignty that drives the move towards judicial dialogue in contemporary constitutional developments, I suggest that legal scholars shift focus of attention from the idea of dialogue to the enhanced judicial role in the new constitutional era. I aim to shed theoretical light on the meaning of judicial dialogue by comparing its practice in different jurisdictions. I first examine the practice of dialogic judicial review in Westminster democracies and constitutional departmentalism in American constitutional theory, showing the tendency toward judicial supremacy in both cases. Turning finally to continental Europe, I argue that the practice of constitutional dialogue there is reconciled with its postwar tradition of judicial supremacy through the deployment of proportionality analysis-framed judicial admonition. The defeat of the Constitutional Treaty by French and Dutch voters in 2005 and the following stalemate of the Lisbon Treaty have sparked a soul-searching process for European constitutional scholarship. Among the numerous academic efforts devoted to contemplating the future of European constitution, Michelle Everson and Julia Eisner's The Making of a European Constitution: Judges and Law Beyond Constitutive Power deserves a close look. Everson and Eisner argue for a postconstituent view of European constitutionalization, which they call ‘Rechtsverfassungsrecht’. Departing from (...) the myth of the constituent power, they interpret the development of a European constitution as a self-creating process by which the ordinary legal system gives itself a set of core values and thereby remakes itself into a constitutional order. Moreover, against the criticisms of juridification, they defend this lawyer-centred process of European constitutionalization as incorporating politics into the daily operation of the legal system. Engaging with Everson and Eisner's argumentation, I argue that their account of European constitutional development does not so much put out a realist theory of the EU constitutionalization as sets out a realist academic lawyering for the next round of European constitutional politics, which is shared among European constitutional scholars. Contrasting this community-based legal profession in Europe with the situation of epistemic pluralism in American jurisprudence, in this article I observe that a lawyer-centred European constitutional theory as Everson and Eisner's book illustrates is premised on an inherited consensus that has held a European legal profession together. However, this lawyer-centred account of European constitutionalization presumes either the projection of a professional community onto a Europe-wide civic culture or the self-appointment of legal professionals as the fiduciary of the citizenry. Each is a fiction, however. This fictional character of the legalist-constructivist strategy to European constitutional politics is the underlying cause of the dilemma facing European constitutional ordering. (shrink)

Nishida in his writings pursued two main lines of thought, which are almost equally pervasive and persistent. These are the philosophy of self-consciousness, which is mainly religious and soteriological, and the philosophy of history-politics, which is fundamentally historical and political. Both philosophies are essentially ontologies, by virtue of the application of ontological operators. These operators function in almost every phase of Nishida's philosophy, with the notable exception of his discussion of the sciences, and in the main include activity, self-determination, actuality, (...) one-qua-many logic, and immanent-qua-transcendent logic. Once they are at work, whatever entity they apply to will have full reality in Nishida's texts. In general, the operators are applied in turn to pure experience, an artistic creation, an act of self-consciousness, a historical epoch, the state, and the Emperor, in their chronological order in Nishida's texts. The extension of his ontological operators from acts of self-consciousness to a historical epoch is what I call the turn in Nishida's philosophy. This occurred about 1931 and is the most decisive shift in Nishida's philosophy, because it paved the way for Nishida's return to the world which he had once rejected and called transitory. This turn signifies that the applications of these ontological operators are turned from conscious phenomena to non-conscious phenomena, and also reflects Nishida's own critical stance toward his earlier religious-soteriological philosophy. ;Nishida's extension of ontological operators to his historical-political thinking, or his assertion of a direct union of self-consciousness and the historical world, is seen as fundamentally inappropriate. It fails to appreciate the incompleteness of a historical epoch and the culpability of the state. I call this union a category mistake, since acts of self-consciousness and a historical epoch are not similar enough to be treated by similar ontological operators. Nishida's later philosophy may be seen as his effort to overcome his earlier sharp distinction between homo interior and homo exterior by giving fuller reality to the latter. But the manner in which Nishida overcomes his internalism remains fundamentally internal, since the ontological operators themselves, which he uses to overcome that internalism, are originated from his discussion of aesthetic creativity and creative acts of self-consciousness. If, today, ‘politics is in culture and culture is relentlessly political’ (Brown, 2002), if the domains of ‘the political’ and ‘the cultural’ can no longer be easily distinguished or kept separate, then contemporary political theory requires an understanding and analysis of cultural politics. This essay undertakes the first stages of such a project by trying to theorize ‘cultural politics’. I argue that ‘cultural politics’ proves to be an object of discourse — it indeed has a certain discursive existence — but (...) not an object of discipline, since no single field or discipline produces it as an object of knowledge. I read this disciplinary failure optimistically, arguing that the study of cultural politics requires a reorientation of theory. The sort of interdisciplinary and multiple-genre work needed to study cultural politics produces a conception of theory as fugitive. Fugitive theory must travel among disciplines, calling on a variety of theoretical and political resources to sustain itself; it refuses the very notion of ‘applied’ theory, insisting that theory ‘is already at work’ in politics (Butler, 1997). To link politics to culture is to practise fugitive theory. And the practice of fugitive theory therefore has the capacity to reveal and explore the workings of cultural politics. (shrink)

There is no consensus concerning how to understand the ‘two-step proof structure’ (§§15–20, 21–7) of the Transcendental Deduction in the B-edition of the Critique of Pure Reason. This disagreement invites a closer examination of what Kant might have meant by a ‘transcendental deduction’. I argue that the transcendental deduction consists of three tasks that parallel Kant’s broader project of a ‘critique’ of pure reason; first, an origin task to justify reason’s authority to use them; second, an analytical task that determines (...) the conditions under which this authority can be legitimately exercised; and third, a dialectical task to determine the conditions under which this authority cannot be legitimately exercised. So long as we continue to read the B-Deduction solely in terms of its two-step proof structure, we overlook how Kant’s notion of ‘critique’ constitutes the real grounds for his argumentative strategy there. If the subjective materialism must be a definition of western philosophy, then the thinking of “Rune” must be the product of oriental philosophy. 4. Meanings of the new philosophy: Subjective materialism philosophy must be different from modern west philosophy and postmodern philosophy. And it’s essential meaning is rebuild the philosophy and put the metaphysics in our view once again. So, both the conception of the world and the methodology of “Rune” structure are the completely subversion to all the monism philosophy, and are the completely new structure system of philosophy ontology. Company–cause fit has been one of the major issues in the domain of corporate social responsibility. This study tries to expand the perspective from company–cause to company–non-profit organization (NPO) fit, and it gives implications to firms looking for long-term collaboration with an NPO. Specifically, it suggests three types of fit, i.e., familiarity, business, and activity fit and investigates the potential effects of these fits in social alliances between companies and the partnering NPOs on consumer attributions of the firms’ motives for (...) the alliances. An experiment that used scenarios revealed that consumers perceive high-fitted alliances on the dimensions of the familiarity and activity fit as being more public-serving than low-matched ones. However, the consumers’ attribution of the motive is not different between the high and low business fit. The implications of the research results are discussed from an academic and practical standpoint. (shrink)

This longitudinal study examined the development of moral judgement in 37 nursing students attending a university in Suwon, Korea. The participants completed the Korean version of the Defining Issues Test to allow analysis of their level of moral judgement. The development of moral judgement was quantified using ‘the moral development score’ at each stage (i.e. the six stages detailed by Kohlberg) and the ‘P(%) score’ (a measure of the overall moral judgement level). The results were as follows: (1) the moral (...) development score for stage 5A was consistently the highest across the four years of the students’ course, showing significant differences in some sociodemographic factors including home, birth order and monthly income; and (2) the P(%) score was higher in fourth-year (47.47 ± 11.21) than in first-year (46.13±9.73) students. There was no significant difference in the P(%) score according to sociodemographic factors. Further studies will examine in detail the correlation between curriculum and moral judgement development. We suggest that courses in ethics education should be made more relevant. (shrink)

Contextualising biblical teaching entails the adoption of certain forms, terms or thought patterns that might confuse the original message, especially if the effort takes place in a Javanese culture context that is full of subtlety and indirect communication. This study analyses a Javanese poetry form that contains the narrative of Jesus’ encounter with a Samaritan woman. The indigenous poems are widely sung by the adherents of Javanese indigenous religions. However, only a few studies are conducted on such indigenous poems (...) that contain Christian messages. This study examines whether or not the poetry form and religious terms that the writer used could serve as a vehicle to convey the good news message of the narrative of John 4:4–42 instead of creating impediment. Through literary form analysis followed by content analysis, the results showed that the Javanese poem contains several cantos, each with an embedded meaning. Finally, it intends to demonstrate how a combination, instead of contestation, of the indigenous, Islam and Christian terms is effective for the writer’s purpose. Thus, the writer’s choice was suitable in his effort to communicate the original teaching.Contribution: This study contributes to inter-religious communication by identifying the Javanese indigenous communication pattern, particularly the placement of their messages inside their poem’s structure and in various terminologies. Strengthening inter-religious communication to create a mutual understanding in Indonesian pluralistic society is needed especially as the Javanese indigenous religions are often misunderstood. The thirty-three sections of the Chuang Tzu annotated by Kuo Hsiang of the Chin dynasty were published during the period of the Northern Sung dynasty. Meanwhile, a preface allegedly by Kuo Hsiang was also printed in the book. The preface is as follows:Chuang Tzu was a man who had good knowledge of the origins of things in the universe and avoided no fantastic ideas. His remarks are hard to understand yet pertinent to phenomena. Any remark which is hard to (...) understand yet pertinent to phenomena may be true but useless; any remark which touches no actual things may be lofty but impracticable. This is surely different from a reluctant rise after inability. If the mind is free from preoccupations, it will respond to events at any time, and as a result, remarks will be cautious. Adapting himself to changes in the universe, Chuang Tzu was not merely turning out writings in the form of dialogues on things beyond human experience. (shrink)

This study aims to determine the motive that led to the establishment of Juche by Kim Il Sung amidst the influence of communism and its transformation into religion in North Korea. North Korea is a communist country dictated by Kim Jong-Un of the Kim dynasty and known for its cruelty. The country underwent several changes from Marxism-Leninism to familism to determine its strength in Juche. This ideology that acts as a religion was influenced and strengthened Kim Jong Il to (...) Kim Jong-Un and built by shifting the concept of marxism-Leninism to construct a new understanding of Juche. It will be demonstrated that this ideology was influenced by Confucianism, Christianity, Nationalism, Chinese Communism, and Russian Communism. In the modern era, imperialism was used as an ideological tool to restrict backwardness. This theory allegedly helped Kim Il-Sung establish a unitary, one-person rule over North Korea. ‘It will be examined whether Juche ideology is a tool the state has used to convince people of their government. Pronouncements, an intentional religion in which the people were to believe that their Ruler was a supreme human or an ideology that morphed into a religion’. It will be demonstrated that, when they started honoring Kim as their god, no other religion was permitted.Contribution: This research offers readers an understanding of the value of humanity in the binding ideology of Juche. However, the Juche Ideology can serve as a missiological bridge towards mission goals, which require the experience of spiritual, physical, and social liberation. (shrink)
